After suffering a major legal setback in the summer, Arizona regained its footing in court Friday when a federal judge dismissed parts of the U.S. Justice Department's challenge to the state's new immigration law and rejected several claims made by Hispanic activists and Phoenix police officers.
U.S. District Judge Susan Bolton's ruling on Friday struck down the federal government's challenge to the portion of the law that prohibits the transport of illegal immigrants.
It also rejected a challenge from Phoenix police officers and an advocacy group called Chicanos Por La Causa who argued that the cops could be sued for racial profiling if they enforced the law or lose their jobs if they didn't.
Bolton agreed with Arizona that they had no valid claim of immediate harm.

Kobach ran on the simple message, “Stop Voter Fraud.” The Kansas City Star mocked his message as trivial and the candidate as extreme. The Star had been merely parroting the line advanced by the local moderate Republican establishment since Kobach emerged a few years ago: he is too “scary” to win.

ICE Raids Kansas City Club

Last night at the Club Oasis on Southwest Blvd in Kansas City, ICE along with local police raided the night club which on Sundays advertises Latin music. According to reports, some 200 people were detained and issued summons for not having ID another 20 arrested for warrents and felony records. BB assumes that those arrested for having a record were illegal aliens.

November 2nd 2010 in my opinion is one of the top three most important elections in our history.

The 1854 passage of “The Kansas-Nebraska” act began a debate (with violence) that lead to the election of Abraham Lincoln with less then 40% of the popular vote. You know the rest, a ‘war for states rights’.
Another election that ranks in the top three is the one held in November of 2008 which caused the ascension in January 2009 of Barack Hussein Obama. At this point the issues of his birth or religious preference matter little. We cannot allow ourselves to split like the 1860 Democrats which in part, got the other Illinois one term politician elected.
You may not have supported all the Republican candidates elected earlier this month but supporting ‘your’ party’s choice is essential. Stopping Obama’s maniacal race to Socialism is crucial to the future of the United States.
Having said that, it is my intention to take a break from this blog until after the election to devote as much time as I can getting the people elected that will help stop the spending, of this Liberal House, Senate and President. Remember these three names, Obama, Sotomayor & Elena Kagan. If you voted for him please think about what your vote help cause.

Tucked away on page A-16 of the Kansas City Star Saturday morning was a story by The Associated Press describing how a Kansas District Judge with the advice of the (appointed) Secretary of State Chris Biggs to issue an injunction which allows out of state paid petitioners to gather signatures in Kansas.

A federal judge struck down as unconstitutional on Friday a part of a Kansas law that prohibits nonresidents from circulating petitions within the state.

U.S. District Judge Sam Crow ruled that the law violates the First Amendment and issued a permanent injunction prohibiting Secretary of State Chris Biggs from enforcing it.

The order comes after a lawsuit filed in April by the Constitution Party of Kansas. Also named as plaintiffs are Curt Engelbrecht, a Wichita party member, and Mark Pickens, an Arizona man who works as a paid political petition circulator.
The Kansas attorney general's office had joined with the plaintiffs in asking that the statute be ruled unconstitutional - something Daniel Treuden, a Milwaukee attorney who represents the Constitution Party, called "the responsible thing to do.

6. My dad will fight for Kansas farmers. He learned Ag issues on the seat of a tractor, not from serving on an Agriculture Committee. When the EPA wanted to tax livestock emissions (you know, cow gas!), the Agriculture Committee and Jerry Moran didn't stop it. When my dad saw what this tax would do to Kansas farmers, he sponsored legislation to withdraw the EPA's funding to write the regulations and he stopped the tax dead in its tracks. This bill only extends for one year. If Kansas doesn't send Todd Tiahrt to the Senate, I don't know who will lead this charge next year.

Here's the video from Congressman Pete Stark's Town Hall meeting last Saturday (June 26, 2010).

I used the border segment only (YouTube has a ten minute limit), the rest of the meeting was pretty tame anyway.
He made some pretty dumb comments as he mocked me including "the borders are quite secure", but it backfired on him.
Stark seemed medicated to me, had swollen ankles and could only sit on the edge of his chair for over an hour and a half. He's well past doing an effective job, but in my opinion, that's probably a good thing for America anyway.

And he will most likely be reelected

Garden City’s racial diversity is a look at America’s future

"For a growing number of immigrants, home is far west Kansas in a city of 28,000, a world away from Mogadishu, Mexico City and Myanmar.

It's where women in burqas stroll down a Norman Rockwell Main Street festooned with early Fourth of July banners. And where a Buddhist temple sits alongside grocery stores selling Mexican soft drinks and 50-pound bags of jasmine rice."

The plant

The plant was once the largest beef processing plant in the world, butchering up to 5,700 cattle a day. Tyson employs 3,100 workers, more than the next six largest employers in Finney County combined. The plant buys $1 billion worth of cattle each year, many from nearby ranches.

Wages start at $12.30 an hour, and it’s tough, bloody work.

>snip< Like their predecessors, the new immigrants bring their own cultures and controversies. Last month, Somali residents ruffled some feathers in Garden City after they requested a Muslim-only section in the city cemetery for religious reasons.
“This is our home now,” said Abdulkadir Mohamed, a Somali Muslim and translator at the Tyson plant who moved here in 2006. “But we need a place for us in the cemetery.”
“We’ve been too politically correct for too long,” said Leonard Hitz, a former Marine, retired banker and self-described cowboy poet. “If you want to come to this country and be an American, you’re welcome. But learn the language and assimilate.”

“The people I talk to here are in the complete support of the Arizona law,” Jordan said. “The government needs to secure our borders.”

Imagine the challenge of teaching 3,000 schoolchildren who speak a language other than English. The district, which has 7,400 pupils, had to hire more English language teachers. Even the cafeteria menu was changed to offer familiar foods.
But thanks to the community’s number of low-income immigrant households, the school district receives more money than other districts. Indeed, Garden City schools get $60 million in state and federal funding, compared with the $40 million received by the similarly sized De Soto district.

Politico's Josh Gerstein "Under the Radar" today published the Supreme Court's opinion regarding petitions; in this case it is Washington State's statute allowing public disclosure of signers. In the written opinion there may be a clue as to how the highest court in the land may lean when the new Arizona statute requiring state peace officers to enforce federal immigraition laws.

Afghan Taliban Hang 7-Year-Old Boy to Punish Family

A 7-year-old boy was murdered by the Taliban in an apparent act of retribution this week. Afghan officials said that the child was accused of spying for U.S. and NATO forces and hanged from a tree in southern Afghanistan.

Daoud Ahmadi, the spokesman for the provincial governor of Helmand, said that the killing happened days after the boy's grandfather, Abdul Woodod Alokozai, spoke out against militants in their home village.
Ahmadi said: "His grandfather is a tribal elder in the village and the village is under the control of the Taliban. His grandfather said some good things about the government and he formed a small group of people to stand against the Taliban. That's why the Taliban killed his grandson in revenge."
Shamsuddin Khan Faryie, an elder in the boy's home village of Heratiyan, said that the victim was seized as he played in his garden. He was found hanged from a nearby tree.
The killing of children to punish their families has echoes of Western mafia-style violence. Under Pashtunwali, the ancient honor code of the Pashtuns, it is likely to provoke more vendettas and blood-letting. (More)

Kobach begins campaign for Kansas secretary of state

Republican Kris Kobach formally began his campaign to be Kansas secretary of state on Tuesday with a promise to aggressively pursue election crimes.
“I would be transforming the model somewhat, from a ministerial model to more of a law-enforcement model,” Kobach told reporters after filing the paperwork to run.
The Piper resident said he supported requiring all voters to show a photo ID at the polls and requiring those registering to vote to prove U.S. citizenship.
Kobach also said he would help prosecute election fraud crimes and, if allowed by the state attorney general, defend a state voter ID law against legal challenges. Kansas has no such law currently, but Kobach said he had a bill drafted and ready for legislative consideration.
Kobach, 43, said he would take a leave of absence from his faculty position at the University of Missouri-Kansas City law school to campaign.
He ran for Congress in 2004 and later led the state Republican Party. He also was one of the drafters of Arizona’s new law targeting illegal immigrants.
Kobach faces Shawnee County Elections Commissioner Elizabeth Ensley and Salina resident J.R. Claeys in the Aug. 3 GOP primary.

PHOENIX — Hundreds of people supporting Arizona's new law cracking down on illegal immigration rallied near the state Capitol on Saturday afternoon in soaring temperatures.

Hundreds of motorcycle riders kicked off the downtown Phoenix rally by riding in a procession around the Capitol. Supporters waved American flags and some carried signs that read "What part of illegal don't they understand?"

"For them to come here when it's over 100 degrees and stand in the heat — it's awesome," said 32-year-old Stephanie Colbert of Glendale.

Colbert, who works in a restaurant, said those who disagree with the law and boycott Arizona are misguided because they hurt the immigrant community they aim to support.

"The hospitality industry has a very large population of immigrants, legal and illegal," she said. "It's those people's jobs that are in jeopardy."

Steineger faced two allegations in a civil fine determination hearing.
The first allegation dealt with polls Steineger took to measure his statewide name recognition in hypothetical gubernatorial or secretary of state races.
Steineger paid for those polls taken in March 2009 and November 2009 with funds from his State Senate campaign account, which was a violation of ethics rules. Steineger received a $5000 civil fine for this violation. The vote was a unanimous 9-0.

Billy Blogger supports any law enforcement effort weather it's a Security Guard working working the overnight shift to covert operatives working overseas but this small group of Federal Officers may need a bit of retraining.

I hope these folks send a DVD to the Chief of Police & any other agency that attended the very small informational effort; small that is until the one man with some authority tried to extend it.
The real police officers (except one) apparently knew the law and should be commended. I’m recalling from my long past journalism days that the sidewalk surrounding a Federal Court was considered as part of the building but I could be wrong.

Concerning the Kansas Personal and Family Protection Act

H Sub for SB 306 makes several amendments to Personal and Family Protection Act, which established the concealed carry law. These changes include:

• Change the term “weapon” to “handgun” in the Act;

• Removes a number of current requirements to qualify to carry a concealed handgun;

• Allows a person to carry a concealed handgun while the application is pending if certain criteria are met;

• Eliminates certain requirements for license renewal;

• Reduces the current fees for licensure and renewal

• Eliminates the requirement for fingerprinting of applicants for renewal and adds a requirement for a name-based national criminal records check for renewal;

• Extends the term of a license for 90 days after a person is no longer a resident of Kansas;

• Modifies the provision governing the public and private places a licensee may not carry a concealed handgun, including deleting the prohibition of carrying a concealed weapon on the state fair grounds;

• Excludes parking lots and garages from being included in any public or private facility where a concealed handgun is prohibited;

• Revises the sign prohibiting the concealed carry of handguns.

The bill takes effect upon its publication in the Kansas Statute Book

Sex offenders can be kept in prison, justices rule

They may be held beyond their terms if considered dangerous

WASHINGTON - The Supreme Court ruled Monday that federal officials can indefinitely hold inmates considered "sexually dangerous" after their prison terms are complete.
The high court reversed a lower court decision that said Congress overstepped its authority in allowing indefinite detentions of considered "sexually dangerous."

Great SoCal Patriots Rally today! About 100-120 Americans gave up their Saturday afternoon to Rally for America and law enforcement today at the Federal Building (ICE, Border Patrol) in San Diego. Peaceful rally. SDPD was very helpful in protecting our free speech from the anarchists. Several hundred anti-American goons arrived around 1:40 after a march from their rally in Chicano Park about 3 miles to the south. Dozens of large Mexican flags and angry, hateful protesters tried to confront us and take our ground. About 40-50 cops kept them at bay - barely.

There were two attacks on us. The first was a full water bottle hurled at our group which luckily did not hit anyone.
The second was a violent attack on an America rallier as he walked to his car about a block from the rally. Two Mexican kids approx. 16 years old on bikes rode by Tony and one punched him in the head, then rode off.

"May 1st 2010 A thousand Hispanic Mexican march rallying for immigrants rights from Chicano park in San Diego to downtown federal bldg where San Diego Minutemen await them with Patriot protest and local tea party groups in support."

Arizona’s offense is to attempt to enforce the nation’s immigration laws, in the absence of any serious commitment by the federal government.

The Arizona law makes it a state crime for aliens not to have immigration documents on their person. This sounds draconian, except it’s been a federal crime for more than half a century — U.S.C. 1304(e). Has the open-borders crowd forgotten that it calls illegal aliens “undocumented” for a reason?

Small Riot Breaks Out at Immigration Protest

The fight over Senate Bill 1070 took to the streets of downtown Phoenix, as riot Police were called to the Capitol to control an unruly group of protesters.
Witnesses say a group protesting against SB1070 began to fight with a man who was for the controversial immigration bill.
Police tried escorting that man away from the scene, fearing for his safety, when they too came under attack by people throwing items, including water bottles.

Court in New York gives government a victory against ACORN

A federal appeals court on Wednesday handed the government a victory by temporarily blocking a judge's finding that Congress was wrong to halt federal funding to the activist group ACORN.
The 2nd U.S. Circuit Court of Appeals in Manhattan also agreed to expedite the government's appeal of U.S. District Judge Nina Gershon's rulings that the funding cutoff was unconstitutional. Oral arguments were likely to occur before July.
The appeals court's one-paragraph decision to freeze Gershon's two rulings that found Congress acted unconstitutionally will remain in place until the 2nd Circuit rules on the merits of the government's appeal. It acted a day after hearing arguments. Link to: Read More

Kansas: Governor Signs Castle Doctrine Clean Up Bill

Today, Governor Mark Parkinson (D) signed Senate Bill 381 into law. This bill, more commonly known as “castle doctrine” legislation, will make important corrections to Kansas’ current self-defense statute.

The recent Kansas Supreme Court Ruling in State v. Hendrix stated that if a person threatens force instead of actually using deadly force, the individual is not entitled to a self-defense jury instruction and could be charged with aggravated assault. The ruling was applied to an individual who threatened force (but never discharged the firearm), when his fiancée was assaulted and was subsequently charged and given a felony conviction. He is now a prohibited person for exercising his God-given right of self-defense.

NRA has diligently worked with the legislature in both chambers to make sure that Kansas citizens’ self-defense rights are clearly articulated to minimize the chances that the State Supreme Court will misinterpret the legislature's intent.

I don't know about you, but this would slow me down! People slow down and try to "straddle" the hole.

This is actually a speed control device that is in use. It is much cheaper than speed cameras.

Pro-abortion Governor Mark Parkinson today vetoed legislation which would have required abortionists to cite the specific medical reason for providing a late-term abortion. Currently this information is not included in late-term abortion reports. Senate Substitute for House Bill 2115 also would have allowed civil action to be brought against an abortionist who was believed to have performed an illegal abortion.

The article “Optimism grows ahead of jobs report” (3/30, A1) stated that in some industries — construction in particular — job hunters outnumber job openings about 30-to-1. I assume that our lawmakers will take this into consideration before giving amnesty to 20 million illegal aliens.
I say Americans first. Americans are tired of competing with people who have come here illegally as wages go lower and lower. Amnesty will only encourage more illegal aliens coming here thinking, “If we can hide for a few years, we too will be given amnesty.”

The Arizona House voted Thursday to make the state the third in the nation to allow people to carry concealed weapons without a permit, sending the governor a bill that would allow Arizonans to forego background checks and classes that are now required.
If the legislation is enacted, Arizona would join Alaska and Vermont in not requiring permits to carry concealed weapons. Forty-five other states require permits for hidden guns, and two states - Illinois and Wisconsin - prohibit them altogether.
Supporters say gun restrictions only affect people who want to follow the rules because criminals will carry hidden guns regardless of the law. Nearly all adults can carry a weapon openly in Arizona, and they shouldn't face additional restrictions when they want to hide the weapon, supporters argue.

James Grooms gripped his sign in one hand and held an umbrella with the other Friday while waiting for the Tea Party Express national bus tour on the Statehouse grounds.

His sign read: "Process is Important. Process Obama out in 2012."

The rain didn't deter Grooms, of Topeka, from showing his support for the tea party movement.

"The health care bill was shoved down our throat," he said before the beginning of the rally. "They went behind our backs. I'm really upset about the direction this country is going."

L.D. Morlan, 84, a U.S. Navy veteran in World War II and a U.S. Air Force veteran in the Korean War, was among roughly 550 people from all across Kansas and Missouri gathered on the Kansas Statehouse grounds Friday morning to listen to speakers from the Tea Party Express national bus tour. Morlan chomped on a cigar and carried a small American flag. "I'm mad and I'm scared of what's going on," said Morlan, of Carbondale. "I'm mad at the politics, and they're spending money like it's going out of style. I don't like this health care bill."

C.E. "Sonny" Scroggins carried an American flag on the other side of the street from where roughly 550 people from across Kansas and Missouri gathered Friday morning to listen to speakers from the Tea Party Express national bus tour. Sonny was protesting what he sees as racism within the tea party movement.

Six refuses to challenge ObamaCare

Attorney General Steve Six will not join the coalition of states currently pursuing legal action against the federal health-care legislation. Six issued a statement today commenting that he did not believe that “Kansas could successfully challenge the law.”
Kansas Republican leaders and candidates requested that Six join the 14 other states who are examining the constitutionality of the reform, which mandates that every United States resident purchase health insurance. The bill also creates an unfunded mandate requiring the state to expand Medicaid coverage.
